These Terms govern your use of Phosify, an AI-powered website building platform ("the Service"). By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of a business, you represent that you can bind that business to these Terms.
You must provide accurate information and keep your credentials secure. You are responsible for activity under your account. You must be at least 18 years old or the age of majority in your jurisdiction.
Paid plans are billed monthly in advance via Stripe and renew automatically until cancelled. You can cancel anytime; access continues until the end of the paid period. Fees are non-refundable except where required by law. Building and previewing sites may be free; publishing requires an active plan. Plan limits (number of published sites and AI generations) are described at purchase and in our Fair Usage Policy.
Agency-tier customers may rebrand the platform, connect their own Stripe account, define their own client plans, and bill their clients directly. In that case: (a) the agency — not Phosify — is the merchant of record for its clients; (b) payments between agencies and their clients are processed through the agency's Stripe account under Stripe's terms; (c) agencies are responsible for their own pricing, taxes, refunds, client support, and compliance; and (d) clients of an agency are also bound by these Terms with respect to their use of the underlying Service.
The Service uses third-party AI models to generate website content and stock imagery providers for photos. You own the websites you create with the Service, subject to third-party rights in stock assets. AI output can be inaccurate or similar to other generated content; you are responsible for reviewing and ensuring your published content is lawful, accurate, and doesn't infringe third-party rights.
You may not use the Service to publish unlawful, infringing, deceptive, or harmful content; to send spam or distribute malware; to attempt to breach, overload, scrape, or reverse-engineer the Service; or to circumvent plan limits. We may remove content or suspend accounts that violate these Terms.
You retain ownership of content you upload (logos, photos, text). You grant us a limited license to host, process, and display that content solely to operate the Service. We may remove content that violates these Terms or applicable law.
Custom domains require DNS configuration with your registrar; you are responsible for your domain registrations. The Service depends on third-party providers (hosting, payments, AI, email). We are not liable for outages or changes in those services beyond our control.
You may stop using the Service anytime. We may suspend or terminate accounts for breach of these Terms, non-payment, or legal requirement. On termination, your published sites may be unpublished and your data deleted after a reasonable period.
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Phosify's total liability for any claim is limited to the amounts you paid us in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages, or for losses arising from agency-client relationships described in Section 4.
We may update these Terms; material changes will be notified via the Service or email, and continued use constitutes acceptance. These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law rules.
